Buying agricultural land for a house in UP: land-use change under Section 80
A small plot marked out on farmland is not automatically ready for a house. Check the land’s revenue status, the Section 80 paperwork and the planning authority’s permissions before you commit.

What Section 80 deals with
Section 80 of the Uttar Pradesh Revenue Code, 2006 concerns declarations for use unconnected with agriculture, including residential, commercial and industrial purposes. The published Revenue Code Rules identify the Sub-Divisional Officer as the officer dealing with these declarations. Buyers will commonly approach the SDM office for the relevant subdivision.
“Conversion done” is not enough detail. Ask to see the complete order, its legal provision, covered land and conditions. An application acknowledgement shows that something was submitted; it does not establish that the authority granted the requested declaration.
The published 2019 amendment distinguishes existing non-agricultural use under subsection (1) from proposed future use under subsection (2). It expressly says a subsection (2) declaration does not itself change land use. Have the SDM confirm the current amended provision and the effect of your particular order; do not treat every document headed “Section 80” as equivalent.
Who applies, and what should buyers request?
The published provision refers to a bhumidhar with transferable rights: a tenure holder whose recorded rights permit transfer. Establish who holds those rights for the land being offered. A sales agent’s involvement does not, by itself, show that the agent can apply or bind the owner.
Before buying, request the current revenue record, ownership documents, village and tehsil details, khasra or gata numbers, area and any existing Section 80 order. If someone applies through a representative, ask the office what authority that representative must produce.
For jointly held land, a disputed share or a proposed purchase of only part of a holding, get advice on the correct applicant and process. Do not assume you can obtain every necessary permission after paying the seller. Make the intended residential use explicit during your document review.
Where to find the official online route
The Board of Revenue service listings identify “कृषि से अकृषक / भूमि उपयोग परिवर्तन” under Section 80. The official RCCMS Section 80 login provides a mobile-number and OTP route, with an application-search option. This is a government service, distinct from private websites offering to arrange conversion.
The old Board of Revenue homepage now announces a move to bor.up.gov.in. Start with the official notice or the verified RCCMS address. Some pages were intermittently unavailable during this review; an unavailable page does not mean the legal requirement has disappeared.
- Identify the correct landholder, tehsil and land numbers before opening an application.
- Read the current service instructions and obtain the office’s document checklist for your case.
- Enter the ownership, land and proposed-use details requested, and review them against the records.
- Keep the submitted application reference and any official payment receipt.
- Track the application through the service and obtain the complete decision, including any attached conditions or map.
These are preparation steps, not a claim that every application can be completed without visiting an office. Ask the SDM or tehsil help desk about inspection, demarcation, missing records and the current fee. Do not rely on a broker’s promised completion date.
Check the order against the actual plot
The published rules describe identifying particulars for declarations, including the land number and area, village, tehsil, district, tenure holder and date. Use these to compare the order with the seller’s deed and the site. Ask the issuing office to verify the record if anything differs.
Where an order concerns only part of a larger holding, have that part identified on the relevant map. A certificate covering neighbouring land or another portion of the same gata is not a satisfactory explanation for your plot. Keep a copy that includes every page and attachment.
Ask whether conditions remain outstanding and whether any later order changes the position. If the seller relies on an older declaration or a newer exemption, request the exact order and legal basis, then have the office confirm its applicability. This guide does not certify an individual parcel’s status.
Section 80 does not replace LDA or KDA approval
Revenue treatment and planning permission answer different questions. Section 14 of the UP Urban Planning and Development Act, 1973 addresses permission for development in a notified development area and conformity with applicable plans.
If the land falls within LDA or KDA jurisdiction, ask the authority to confirm permitted use and the layout and building approvals required for the proposal. A Section 80 declaration alone does not establish that the advertised colony layout has been sanctioned or that your house plan is approved.
Equally, do not assume that every case necessarily requires two independently issued documents: ask the offices whether the current law gives an authority permission any corresponding revenue effect. Require the applicable written basis. A seller’s verbal claim that “one approval covers everything” is insufficient.
Why this matters for plotted farmland
Ask the seller to connect three things: the revenue parcel, the advertised plot and the approved development drawing. If those cannot be matched, you cannot tell which piece of land the documents describe. Roads drawn in a brochure should also be checked against the sanctioned plan and the site.
For a marketed project, inspect the relevant UP RERA records as a separate check. Keep copies of what the seller promised about use, approvals and access. Have a lawyer review those promises before signing a booking or sale agreement.
Red flags and buyer checklist
Pause over “conversion later”, a cropped order, mismatched land numbers, another phase’s approval or pressure to pay before inspection. These are reasons to investigate, not conclusions that the seller has committed fraud.
- Confirm the seller’s recorded rights and authority to sell.
- Match the declaration to the exact area offered.
- Have the SDM explain its current effect and conditions.
- Confirm planning jurisdiction and residential-use requirements.
- Inspect the sanctioned layout and required building permissions.
- Resolve the written conditions before committing to construction.
Frequently asked questions
Can I build a house just because I bought agricultural land?
Do not assume so. Have the revenue office and the competent planning authority confirm the requirements for residential use and construction on that exact parcel.
Who normally applies for a Section 80 declaration?
The published provision refers to the bhumidhar with transferable rights. Confirm the applicant’s recorded rights and any representative’s authority with the SDM office.
Does Section 80 mean the colony is LDA or KDA approved?
No. A revenue declaration alone does not establish layout or building approval. Verify the specific planning permission and any corresponding revenue effect under the current law.
What should I do if the portal is unavailable?
Take the land details and documents to the SDM or tehsil office. Ask for the current application route, document requirements and a traceable acknowledgement.
